1. Acceptance of Terms

By accessing and using PawSpy (the "Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

PawSpy is a pet tracking platform that allows users to create profiles for their pets and share sighting information with others. The Service enables users to upload photos, post locations, and comment on pet activities.

3. User Content and License

By uploading content (photos, comments, location data) to PawSpy, you:

• Confirm you own or have the legal right to upload and share the content
• Grant PawSpy a worldwide, non-exclusive, royalty-free license to store, display, and publicly share your content
• Acknowledge that all content uploaded is PUBLIC and accessible to anyone with the tracker link
• Understand that content may remain visible even after account deletion
• Agree not to upload content that violates copyright, privacy rights, or contains illegal material

4. Public Nature of Content

IMPORTANT: All content is PUBLIC and accessible to anyone.

All pet profiles, photos, sightings, and comments are publicly accessible. Anyone with your pet's tracker link can view all associated content including:

• Always Public: Pet names, pet photos, sighting photos, locations, timestamps, and comments
• Anonymized in Preview Mode: User names (reporters, commenters) are anonymized for users accessing via preview links
• Visible to Logged-In Users: Real user names are visible to those with direct tracker access

Do not upload sensitive, private, or confidential information. All images are publicly accessible without anonymization.

5. User Responsibilities

You agree to:

• Provide accurate information
• Not impersonate others or create fake profiles
• Not upload harmful, offensive, or illegal content
• Not attempt to hack, disrupt, or abuse the Service
• Keep your password secure and confidential

6. Age Requirement

You must be at least 13 years old to use this Service. If you are under 18, you must have parental consent.

7. Content Removal

PawSpy reserves the right to remove any content that violates these Terms, is reported as inappropriate, or is deemed harmful to the Service or other users, without prior notice.

8. Copyright and Content Removal Requests

If you believe content on PawSpy infringes your copyright, privacy rights, or other legal rights, please email us at support@pawspy.xyz with:

• Your contact email
• Pet name and description of the infringing content (photo, comment, location, etc.)
• Explanation of why the content should be removed
• If claiming copyright: proof of ownership or authorization

We will review and respond to valid requests within 7 business days. Repeat infringers may have their accounts terminated. Note: We do not collect user contact information during registration, so removal requests must come via email.

9. Disclaimer of Warranties

The Service is provided "AS IS" without warranties of any kind. PawSpy does not guarantee uninterrupted access, data accuracy, or that the Service will meet your requirements. Use at your own risk.

9. Limitation of Liability

PawSpy and Stackwood Services shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to data loss, privacy breaches, or pet-related incidents.

10. Indemnification

You agree to indemnify and hold harmless PawSpy and Stackwood Services from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

PawSpy reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Termination

PawSpy may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason, with or without notice.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in New Zealand courts.
